By visiting this website, requesting early access, creating an account, or using EmailMyChecks, you agree to these Terms of Service. If you use the service for a company, law firm, process serving company, or other organization, you represent that you are authorized to accept these terms for that organization.
EmailMyChecks provides software for composing, sending, tracking, and reconciling check-based payments by email. Recipients may be able to print and deposit checks or choose available electronic deposit options. Certain payment movement, ACH, verification, and banking functions may be provided by third-party financial, payment, or technology partners.
Email delivery, payment status, print-and-deposit availability, ACH timing, and settlement may depend on recipient action, banking hours, payment partner review, risk controls, holidays, network rules, and third-party systems. We do not guarantee that a recipient will print, deposit, accept, or successfully receive any payment by a specific time.
You are responsible for ensuring each payment is valid, authorized, properly documented, and compliant with applicable laws, contracts, court rules, client instructions, and professional obligations. EmailMyChecks does not decide whether a payment is legally owed.
You may not use EmailMyChecks for fraud, money laundering, unauthorized debits, sanctions violations, illegal goods or services, deceptive activity, harassment, infringement, or any payment you are not authorized to make. We may review, limit, suspend, or terminate access when we believe activity creates legal, compliance, security, or operational risk.
EmailMyChecks may integrate with services such as QuickBooks Online, PST Process Server's Toolbox, ServeManager, email providers, identity providers, payment processors, and financial institutions. Your use of those services is also governed by their terms and policies. We are not responsible for third-party outages, data errors, rule changes, or service decisions.
Fees, included usage, overage pricing, and plan features are described on the pricing page or in an order form. Taxes, payment partner fees, chargeback costs, failed payment fees, or bank fees may apply where permitted. We may update pricing prospectively with reasonable notice unless a signed agreement says otherwise.
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using EmailMyChecks, you authorize us and our service providers to process information necessary to operate the service, verify activity, provide support, prevent fraud, comply with law, and improve the product.
EmailMyChecks, including the website, software, design, workflows, content, branding, and documentation, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes, subject to these terms.
The service is provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation to the fullest extent permitted by law.
To the fullest extent permitted by law, EmailMyChecks will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, payment delays, or third-party service failures. Our aggregate liability for claims relating to the service will not exceed the amounts you paid to us for the service in the three months before the event giving rise to the claim.
